Please read these terms and conditions carefully before ordering any products from our site. Using this Website indicates that you accept these terms and conditions together with our privacy policy. If you do not accept these terms and conditions, do not use this Website.

SERVICE AVAILABILITY

Orders may be placed by individuals in the UK, European Economic Area ("EEA") and most other countries worldwide. Some restrictions may apply.  See our Delivery & Returns page for more information. By placing an order through our site, you agree that you are legally capable of entering into a binding contract, are at least 18 years old, and reside in a country to which we deliver.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to availability and acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched. The contract between us will only be formed when we send you the dispatch confirmation. We will not process your order until payment has been received in full. If you make a mistake with your order, you may be able to correct it by contacting us on [email protected] prior to your order being dispatched. If your order has already been dispatched, please return the products to us in accordance with our returns policy. 

The contract will relate only to those products whose dispatch we have confirmed in the dispatch confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate dispatch confirmation. We are entitled to refuse any order made by you for any reason. All details you provide to us requesting goods or services must be true and accurate, you must be the authorised user of the credit or debit card used, and there must be sufficient funds to cover the cost of the goods and services. It is your responsibility to inform us of any changes to these details as soon as possible.

YOUR RIGHT TO CANCEL THE CONTRACT

If you are an EEA customer you have a right to cancel a contract under the Consumer Contracts Regulations at any time within 30 calendar days. In the case of an order for a single product, the cancellation period begins on the day after you received the product. In the case of an order for multiple products, the cancellation period begins on the day after you received the last product in your order (in the event that the products are delivered on different dates).

YOUR RIGHT FOR A REFUND OR EXCHANGE

If for any reason you are not completely satisfied with the goods we will be happy to offer you a refund or exchange, providing the following conditions are met:

  • Items must be returned within 14 days
  • Items must be in a resalable condition (as new)
  • Items must be complete with all tags and packaging in a reusable condition.

We cannot accept any used items that do not meet these conditions and any such items will be returned to the purchaser. Returns received after 14 days of receipt will only be accepted at the discretion of Pockets.

ALTERATIONS

If alterations are needed they must be paid for by the customer. Once an item has been modified in any way it will no longer be suitable for a return or exchange. 

ITEM OUT OF STOCK

If the product that you have selected is not available will be notified by email and the order will be cancelled, any payment already made by the customer will be refunded in full.

WASHING INSTRUCTIONS 

It is your responsibility to check the washing instructions as stated by the manufacturer on each individual garment's labels. Any information provided by this website is given to aid the buying process only, we shall not be liable for any damage, costs, or expenses caused by incorrect washing.

TRYING ITEMS ON

;When trying on items please ensure that you are in a smoke and scent free environment, and not wearing perfume, aftershave, or a deodorant which may leave a scent or mark on the item. We will be unable to accept the return of any item where there is evidence that these guidelines have not be adhered to.

DELIVERY

Depending upon your location the cost of items on the Pockets website may be estimated in your local currency based on recent exchange rates. However, the true price of the order will be based on the UK price in pounds sterling at the time of purchase. If the purchase is made by a customer living outside the EU, the goods will be sold excluding UK VAT. The customs office may hold your goods if the local import taxes are not paid. Pockets cannot undervalue orders when arranging delivery. The customer takes full responsibility for any postal charges, return shipping costs, customs charges and handling fees should they refuse to accept a parcel due to import duties or taxes.

Pockets are pleased to be able to offer EU and International delivery to most countries worldwide. Please look at the list of available countries at checkout, to determine if your location is available.

Pockets use DPD and DHL Express for all UK orders. International orders (including to EU countries) are shipped via DHL Express Worldwide. Goods will be insured during the time it is in transit up until it is delivered to you or an agreed recipient. 

We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified somebody else to accept the delivery, then you accept that evidence of a signature by them (or somebody at the specified delivery address) is evidence that the delivery has been fulfilled by Pockets. 

Orders placed over a public holiday or weekend will not be dispatched until the next working day. The delivery times indicated are based on working days (Monday to Friday) and delays may be incurred during public holidays.

Please be aware that in the interests of credit card fraud detection and prevention, it is Pockets policy to undertake several checks to ensure the validity of any transaction before goods are dispatched to a customer.

If you have chosen our new HubBox Click & Collect option you will also receive a notification when your order arrives at the designated collection point - please take your HubBox reference number as proof of collection.

PRICE AND PAYMENT

Payment for all items is required prior to dispatch. Prices displayed on the website are in pounds sterling, and include UK VAT but exclude delivery charges. Delivery charges are shown separately when ordering and must also be paid when the order is placed. Payment must be made by the means specified on the website, and shall not be deemed to be made until we have received cleared funds in respect of the full amount stated in the order. Please note that we are unable to accept payment by cheque, postal order, email, bank transfer, or cash on delivery.

As an online store, we will often run short timed sales promotions, allowing you to get items at a lower price for a certain period. Prices are subject to change without notice but changes will not affect orders which we have already accepted. It is not possible to get the difference refunded should you see that the price has changed at a later date. 

Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures, and if an incorrect price is identified we will contact you to ascertain if you wish to proceed with the order at the correct price. We are under no obligation to provide the product to you at the incorrect (lower) price, and it is at Pockets discretion to do so.

At present payment for all products must be by credit or debit card, we also accept payments via PayPal. 

As the cost of your order will be based on the UK price in pounds sterling, the cost of the order in your local currency will depend on the exchange rate at the time of purchase. Whilst prices may be viewed on the website in Euros and Dollars this is an estimate based on recent exchange rates, and may not be an exact reflection of the final order price. We can offer tax-free pricing for non-EU customers, but customs and import duties are the responsibility of the customer. 

Only one promotion code can be used per order.

BULK ORDERS

Where items are purchased in bulk, Pockets reserves the right to charge a shipping surcharge. The customer will be notified of this surcharge prior to dispatch and given the opportunity to cancel or amend the order without penalty. 

FRAUD PREVENTION

All goods sold by Pockets are individually identifiable, guaranteed to be genuine and sourced from official distributors. Returns will not be accepted under any circumstances where labels and tags have been removed, or the garment altered in any way.

OUR LIABILITY

If your order does not arrive, if the products we deliver are not what you ordered or are damaged or defective (unless the damage was clearly stated in the product description on the website) or the delivery is of an incorrect quantity, our only obligation will be, at our option to:

Make good any shortage or non-delivery or incorrect delivery; or replace or repair any products that are damaged or defective, or refund to you the amount paid by you for the products in question.

We shall have no liability to you for any consequential, special or indirect losses including without limit the loss of revenues, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data. Without prejudice to the foregoing, our total aggregate liability to you under and/or arising in relation to this contract shall not exceed the amount paid by you for the products. Nothing in this contract shall exclude or limit your statutory rights. A person who is not a party to this contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract.

INDEMNITY

You agree to indemnify, defend and hold harmless Pockets.co.uk its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.

IMPORT DUTY

If you order products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that We have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

WRITTEN COMMUNICATIONS

When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

TRANSFER OF RIGHTS AND OBLIGATIONS

The contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control. This includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters
  • The impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  • The impossibility of the use of public or private telecommunications networks.
  • The acts, decrees, legislation, regulations or restrictions of any government.

OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements or for any other reason.

PROMOTION TERMS AND CONDITIONS

From time to time Pockets will offer promotional codes which can be redeemed at checkout. Promotion codes can only be used once per transaction and cannot be used in conjunction with any other promotion or offer. Promotion codes remain our property, are not transferable and are not valid for the purchase of gift cards or gift vouchers. There is no cash alternative. 

COMPETITIONS

From time to time pockets may offer competitions, the terms & conditions will be specified when the competition is run, and it will be at Pockets discretion to set and modify them at any time.

GIFT VOUCHERS

The Pockets Gift Card is not a cheque guarantee, credit or charge card. The minimum amount to activate a Pockets Gift Voucher is £1. You may use Pockets Gift Vouchers to make purchases on the Pockets website and at any Pockets store: Shrewsbury, Newcastle-Under-Lyme, Hanley, Nantwich and Worcester. The Pockets Gift Voucher cannot be redeemed via telephone.

If the Pockets Gift Voucher is not used for a consecutive period of 12 months the voucher will automatically expire at the end of that period. To reactivate the voucher, customers have to contact us in store. When you use The Pockets Gift Voucher, the amount of your purchase will be deducted from the balance on the voucher. Change will not be given. You may obtain information about the remaining balance on the card at any store. You may only redeem your Gift Voucher in GB pounds sterling. The Pockets Gift Voucher cannot be redeemed or exchanged for cash. Refunds will not be given for the purchase of a Pockets Gift Voucher. All refunds of goods or services purchased with the Pockets Gift Voucher will be made in accordance with our  Refunds Policy.

Pockets will cancel the value of the Gift Voucher if we fail to receive payment from the purchaser's bank or card company for the initial purchase of the voucher. Further action may be taken where the fraudulent use of a credit card is suspected. For cash purchases of £500 or more we will require proof of identification.

Pockets reserve the right to amend these Terms & Conditions from time to time, where we consider it necessary to do so.

These terms and conditions are subject to change without notice and do not affect your statutory rights as a consumer.
